VENTURIX TRAVEL TERMS AND CONDITIONS

These Terms and Conditions govern all bookings and services provided by Venturix Travel (Pty) Ltd ("Venturix Travel", "we", "us", "our"). By making a booking or accepting our services, you ("the Client", "you", "your") agree to be bound by these terms.

 

 

2. DEFINITIONS

 

 

2.1 "Booking" means any reservation for travel services arranged through Venturix Travel.

 

 

2.2 "Services" means accommodation, transportation, tours, activities, and any other travel-related services provided or arranged by Venturix Travel.

 

 

2.3 "Supplier" means third-party service providers including but not limited to hotels, airlines, tour operators, transport companies, and activity providers.

 

 

2.4 "Commencement Date" means the first day of travel or service as specified in the booking confirmation.

 

 

2.5 "Total Tour Price" means the complete cost of services as detailed in the booking confirmation or invoice.

 

 

3. BOOKINGS AND CONFIRMATIONS

 

 

3.1 All bookings must be made in writing via email, through our website, or in person at our offices.

 

 

3.2 A booking is only confirmed once the Client receives written confirmation from Venturix Travel, which will be issued upon receipt of the required deposit.

 

 

3.3 Verbal quotations are estimates only and Venturix Travel is not bound by any verbal quotation provided.

 

 

3.4 All quotations are valid for 30 days from the date of issue unless otherwise specified.

 

 

3.5 Quotations are based on rates and availability at the time of issue. Prices may be subject to change due to currency fluctuations, fuel surcharges, tax increases, or supplier rate changes until full payment is received.

 

 

3.6 By accepting a quotation, the Client acknowledges having read, understood, and agreed to these Terms and Conditions.

 

 

4. PAYMENT TERMS

 

 

4.1 A non-refundable deposit of 30% of the Total Tour Price is required to confirm a booking.

 

 

4.2 Full payment must be received no later than 60 days prior to the Commencement Date.

 

 

4.3 Bookings made within 60 days of the Commencement Date require full payment at the time of booking.

 

 

4.4 Payment may be made by:

 

 

 

 

 

Electronic Funds Transfer (EFT)

 

 

Credit/Debit card (processing fees may apply)

 

 

Cash (for in-person transactions only)

 

 

 

 

 

4.5 Banking details will be provided on the invoice.

 

 

4.6 For international payments, the Client is responsible for all bank charges, and the full invoiced amount must be received by Venturix Travel.

 

 

4.7 If full payment is not received by the due date, Venturix Travel reserves the right to cancel the booking and retain the deposit.

 

 

4.8 Failure to pay on time may result in loss of guaranteed rates and availability.

 

 

5. CANCELLATION AND AMENDMENT POLICY

 

 

5.1 Cancellation by Client

 

 

5.1.1 All cancellations must be made in writing and are effective from the date Venturix Travel receives written notification.

 

 

5.1.2 Cancellation fees are as follows:

 

 

 

 

 

More than 60 days before Commencement Date: Loss of deposit (30%)

 

 

60 to 45 days before Commencement Date: 50% of Total Tour Price

 

 

44 to 31 days before Commencement Date: 75% of Total Tour Price

 

 

30 days or less before Commencement Date: 100% of Total Tour Price

 

 

 

 

 

5.1.3 In addition to the above fees, any non-refundable costs already paid to Suppliers will be charged to the Client.

 

 

5.1.4 Special cancellation conditions may apply to certain Suppliers (including national parks, private reserves, airlines, luxury lodges). These will be communicated at the time of booking and will supersede the standard policy where more restrictive.

 

 

5.1.5 We strongly recommend that all Clients purchase comprehensive travel insurance that includes cancellation cover.

 

 

5.2 Amendments by Client

 

 

5.2.1 Amendment requests must be made in writing.

 

 

5.2.2 Amendments are subject to availability and Supplier acceptance.

 

 

5.2.3 An amendment fee of R550 per booking will be charged, in addition to any costs imposed by Suppliers or price differences.

 

 

5.2.4 Amendments requested within 30 days of the Commencement Date may be treated as a cancellation and rebooking.

 

 

5.3 Cancellation by Venturix Travel

 

 

5.3.1 Venturix Travel reserves the right to cancel a booking due to circumstances beyond our control, including but not limited to force majeure events, insufficient bookings, or Supplier cancellations.

 

 

5.3.2 In such cases, Venturix Travel will offer alternative arrangements or a full refund of all monies paid. Venturix Travel shall not be liable for any additional expenses incurred by the Client.

 

 

6. PRICING AND PAYMENT

 

 

6.1 All prices are quoted in South African Rand (ZAR) unless otherwise specified.

 

 

6.2 Prices include VAT where applicable.

 

 

6.3 Prices are based on costs, exchange rates, and tariffs in effect at the time of quotation and are subject to change.

 

 

6.4 Venturix Travel reserves the right to pass on any increases in costs, including but not limited to fuel surcharges, taxes, levies, or exchange rate fluctuations, prior to full payment being received.

 

 

6.5 Unless specifically stated, prices exclude:

 

 

 

 

 

International and domestic flights

 

 

Visa and passport fees

 

 

Travel insurance

 

 

Meals not specified in the itinerary

 

 

Beverages (unless specified)

 

 

Personal expenses and gratuities

 

 

Optional activities and excursions

 

 

Airport transfers (unless specified)

 

 

 

 

 

7. TRAVEL INSURANCE

 

 

7.1 Venturix Travel strongly recommends that all Clients obtain comprehensive travel insurance covering, at minimum:

 

 

 

 

 

Cancellation and curtailment

 

 

Medical expenses and emergency repatriation

 

 

Personal accident

 

 

Baggage and personal effects

 

 

Personal liability

 

 

 

 

 

7.2 It is the Client's responsibility to ensure adequate insurance cover is in place.

 

 

7.3 Venturix Travel accepts no liability for any losses that would have been covered by appropriate travel insurance.

 

 

8. TRAVEL DOCUMENTS

 

 

8.1 It is the Client's responsibility to ensure they hold valid passports, visas, permits, and any required health documentation for all destinations on their itinerary.

 

 

8.2 Passports must be valid for at least 6 months beyond the intended return date and have sufficient blank pages as required by immigration authorities.

 

 

8.3 Venturix Travel can provide guidance on documentary requirements but accepts no responsibility for visa refusals or entry denials.

 

 

8.4 The Client is responsible for any costs incurred due to inadequate documentation.

 

 

9. HEALTH REQUIREMENTS

 

 

9.1 Clients are responsible for consulting with a travel health clinic or medical practitioner regarding vaccinations, malaria prophylaxis, and other health precautions for their destination.

 

 

9.2 Certain destinations may require proof of vaccination (such as Yellow Fever).

 

 

9.3 Clients must inform Venturix Travel of any medical conditions, disabilities, or special requirements at the time of booking.

 

 

9.4 Venturix Travel reserves the right to decline a booking or terminate services if medical conditions pose a risk to the Client or other travellers, or if requirements cannot be reasonably accommodated.

 

 

10. RESPONSIBILITIES AND LIMITATIONS OF LIABILITY

 

 

10.1 Agency Capacity

 

 

10.1.1 Venturix Travel acts as an agent for Suppliers of accommodation, transportation, tours, and other services.

 

 

10.1.2 While we endeavour to select reputable Suppliers, we do not own, operate, or control these services.

 

 

10.1.3 Venturix Travel is not liable for any acts, omissions, defaults, or negligence of Suppliers.

 

 

10.2 Limitation of Liability

 

 

10.2.1 Venturix Travel shall not be liable for:

 

 

 

 

 

Death, injury, illness, loss, damage, expense, or inconvenience caused by Suppliers

 

 

Loss of or damage to baggage or personal belongings

 

 

Delays, cancellations, or schedule changes by Suppliers

 

 

Force majeure events including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemics, or government restrictions

 

 

Consequences of the Client's failure to comply with visa, passport, or health requirements

 

 

 

 

 

10.2.2 Where Venturix Travel is found liable, our maximum liability is limited to the Total Tour Price paid by the Client.

 

 

10.2.3 Venturix Travel is not liable for indirect, consequential, or special damages.

 

 

10.3 Supplier Terms

 

 

10.3.1 Clients acknowledge that Supplier terms and conditions apply to services provided by those Suppliers.

 

 

10.3.2 By using Supplier services, Clients agree to be bound by the relevant Supplier's terms and conditions.

 

 

11. COMPLAINTS AND DISPUTES

 

 

11.1 If any issue arises during travel, the Client must notify Venturix Travel and/or the relevant Supplier immediately to allow us the opportunity to rectify the situation.

 

 

11.2 Formal complaints must be submitted in writing to Venturix Travel within 30 days of the completion of travel.

 

 

11.3 Complaints received after 30 days may not be considered.

 

 

11.4 Venturix Travel will investigate all complaints and respond within 30 days.

 

 

11.5 Where a complaint concerns a Supplier, Venturix Travel will liaise with the Supplier on the Client's behalf but cannot guarantee resolution or compensation.

 

 

12. ITINERARY CHANGES

 

 

12.1 While every effort is made to adhere to the planned itinerary, Venturix Travel and Suppliers reserve the right to modify itineraries due to circumstances beyond our control.

 

 

12.2 Alternative arrangements of equivalent or higher standard will be provided where possible.

 

 

12.3 No refunds or compensation are payable for itinerary changes due to force majeure or circumstances beyond our control.

 

 

12.4 Where changes result in lower-cost alternatives, a refund of the difference will be provided.

 

 

13. ACCOMMODATION

 

 

13.1 Hotel ratings and descriptions are provided as guidance based on local standards and may differ from international classifications.

 

 

13.2 Standard check-in time is 14:00 and check-out time is 11:00, unless otherwise specified.

 

 

13.3 Early check-in and late check-out are subject to availability and may incur additional charges.

 

 

13.4 Room configurations (single, double, twin) are subject to availability. While preferences are noted, specific room types cannot be guaranteed unless pre-booked and confirmed.

 

 

13.5 Requests for adjoining or interconnecting rooms, specific views, or floors are noted but cannot be guaranteed.

 

 

14. TRANSPORTATION SERVICES

 

 

14.1 General

 

 

14.1.1 All transportation is subject to the terms and conditions of the transport Supplier.

 

 

14.1.2 Departure and arrival times are approximate and subject to change.

 

 

14.1.3 Venturix Travel is not liable for delays, cancellations, missed connections, or consequences thereof.

 

 

14.2 Road Transportation

 

 

14.2.1 Baggage allowance for road transfers is typically one suitcase (maximum 20kg) plus one carry-on item per person, unless otherwise specified.

 

 

14.2.2 Excess or oversized baggage may be refused or charged additionally.

 

 

14.2.3 Clients must comply with all safety regulations including wearing seatbelts and following driver instructions.

 

 

14.2.4 Smoking is prohibited in all vehicles.

 

 

14.2.5 Consumption of red wine, dairy products, and excessive alcohol is prohibited in vehicles.

 

 

14.3 Air Transportation

 

 

14.3.1 Flight bookings are subject to airline terms and conditions.

 

 

14.3.2 Clients are responsible for checking in on time and complying with airline requirements.

 

 

14.3.3 Baggage allowances vary by airline and fare type. Excess baggage charges are the Client's responsibility.

 

 

15. ACTIVITIES AND EXCURSIONS

 

 

15.1 Participation in activities and excursions is at the Client's own risk.

 

 

15.2 Certain activities have age, health, fitness, or other restrictions. Clients must ensure they meet all requirements.

 

 

15.3 Clients must follow all safety instructions provided by activity operators.

 

 

15.4 Venturix Travel and Suppliers reserve the right to refuse participation if safety concerns exist.

 

 

15.5 No refunds are provided for voluntary non-participation in activities.

 

 

15.6 Wildlife sightings cannot be guaranteed.

 

 

16. BEHAVIOUR AND CONDUCT

 

 

16.1 Clients are expected to conduct themselves in a manner that does not cause distress, damage, danger, or annoyance to others.

 

 

16.2 Venturix Travel and Suppliers reserve the right to terminate services if a Client's behaviour is deemed unacceptable, illegal, or dangerous.

 

 

16.3 No refunds are provided in cases of termination due to unacceptable behaviour.

 

 

16.4 The Client is liable for any damage caused to property or injury caused to persons as a result of their actions.

 

 

17. PRIVACY AND DATA PROTECTION

 

 

17.1 Venturix Travel collects and processes personal information in accordance with the Protection of Personal Information Act (POPIA).

 

 

17.2 Personal information is collected for the purposes of:

 

 

 

 

 

Processing bookings and providing services

 

 

Communication regarding travel arrangements

 

 

Compliance with legal and regulatory requirements

 

 

Marketing (with consent)

 

 

 

 

 

17.3 Personal information may be shared with:

 

 

 

 

 

Suppliers necessary to fulfil your booking

 

 

Payment processors

 

 

Regulatory authorities where required by law

 

 

 

 

 

17.4 Personal information is retained for 5 years in compliance with legal requirements.

 

 

17.5 Clients have the right to:

 

 

 

 

 

Access their personal information

 

 

Request correction or deletion of personal information

 

 

Object to processing

 

 

Lodge a complaint with the Information Regulator

18. FORCE MAJEURE

 

 

18.1 Venturix Travel shall not be liable for failure to perform its obligations due to force majeure events including but not limited to:

 

 

 

 

 

Acts of God (earthquakes, floods, storms, etc.)

 

 

War, terrorism, or civil unrest

 

 

Pandemics or epidemics

 

 

Government actions, restrictions, or regulations

 

 

Strikes or industrial action

 

 

Supplier insolvency or cessation of operations

 

 

 

 

 

18.2 In force majeure situations, Venturix Travel will endeavour to provide alternative arrangements but is not obligated to provide refunds for costs already incurred or non-refundable Supplier charges.

 

 

19. GOVERNING LAW AND JURISDICTION

 

 

19.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.

 

 

19.2 Any disputes arising from these terms or services provided shall be subject to the exclusive jurisdiction of the South African courts.

 

 

19.3 Venturix Travel may institute legal proceedings in any Magistrate's Court having jurisdiction.

 

 

20. GENERAL PROVISIONS

 

 

20.1 These Terms and Conditions constitute the entire agreement between Venturix Travel and the Client.

 

 

20.2 No variation of these terms is valid unless agreed in writing by both parties.

 

 

20.3 If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

 

 

20.4 Venturix Travel's failure to enforce any provision does not constitute a waiver of that provision.

 

 

20.5 These Terms and Conditions may be updated from time to time. The version applicable to your booking is the version in effect at the time of confirmation.

 

 

21. SPECIAL CONDITIONS

 

 

21.1 Group bookings (10 or more passengers) may be subject to additional terms and conditions.

 

 

21.2 Custom or bespoke itineraries may include specific terms outlined in the booking confirmation.

 

 

21.3 Peak season, special events, and holiday periods may be subject to modified cancellation policies and minimum stay requirements.

 

 

 

 

 

By proceeding with a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
